Service Delivery, Termination, and Refunds for Services

Article 1. Scope and application
  1. DISC JOINT STOCK COMPANY, with enterprise code 0108468650 (hereinafter the “Company”), is the owner of the direct-sales e-commerce platform at the domain name discglobal.net (hereinafter the “Platform”).

  2. This document applies from 7:00 a.m. on September 10, 2026, Vietnam time, to services that the Company directly provides under online orders placed on the Platform.

  3. The Company has the right to amend this document for future transactions and publicly announces the time from which the amendment applies. A contract that has already been entered into may be changed only in accordance with the law or a lawful agreement.

  4. Mandatory provisions of the law applicable to a transaction prevail. To the extent permitted by law, a lawful separate agreement prevails with respect to the corresponding matters. Statutory rights, obligations, and time limits vary according to the law applicable to the transaction.

Article 2. Service delivery method
  1. The information applicable to each service is published in the service description, or through a link in that section, on the Platform before the buyer places an order, including:

    a) For services used directly on the Platform: the period of use, compatible types of electronic devices, the number of devices permitted for simultaneous use, specific instructions for use, main features, and limitations during use (if any);

    b) For services ordered in advance and used later: the conditions and form of use at the place of provision, the period of use, exchange conditions, cancellation conditions, and additional costs (if any).

  2. Apart from statutory rights, the buyer may exchange or cancel a service only under a lawful agreement or with the Company’s approval.

Article 3. Cases of service termination and methods for resolving the consequences of service termination
  1. A contract terminates when it has been completed, when it expires without being lawfully continued, when the parties agree to terminate it, when a party exercises a right to terminate or rescind it under the law or a lawful agreement, or when other grounds for termination exist under the law or a lawful agreement.

  2. When a contract terminates, the Company has the right to stop providing the remaining part of the service. The right to access transaction records under the law is not affected. The parties perform their obligations regarding payment, restitution, penalties for breach, and compensation for damage on a lawful basis. The consequences of rescinding a contract are resolved in accordance with the law on contract rescission.

  3. In a distance transaction, if the Company provides inaccurate or incomplete information as specified in Clause 1 of Article 37 of the Law on Protection of Consumer Rights, the consumer has the following rights:

    a) To agree with the Company on how to handle the contract;

    b) To unilaterally terminate the contract and notify the Company within 30 days from the date the contract was entered into;

    c) To request a competent authority to declare the contract invalid or to rescind the contract in accordance with civil law.

Article 4. Time at which the contract ceases to be effective and method of paying service fees where the buyer is the party terminating the contract
  1. Where the buyer has the right to terminate because they no longer need the service, the contract terminates at the end of the third working day for consumers, or at the end of the fifth working day for other buyers, counting from the working day following the day on which the Company receives a notice containing all the content specified in Clause 1 of Article 5, unless there is a lawful separate agreement.

  2. Where the buyer terminates on other grounds, the contract terminates when the Company receives a notice that clearly states the termination request and contains sufficient information for the Company to identify the buyer and the relevant service, unless the law or a lawful agreement provides otherwise.

  3. If the buyer only requests non-renewal, the contract continues until the end of the current term as agreed. Non-renewal does not by itself give rise to a right to a refund.

  4. The buyer pays, using the agreed method, price, and calculation, for the part of the service that the Company has performed in accordance with the contract and for other lawful amounts that have fallen due. A consumer who terminates under Point b of Clause 3 of Article 3, or who unilaterally terminates a continuous service, is required to pay only for the part of the service used, in accordance with the law.

Article 5. Procedure and response time for buyers sending a contract termination notice on the e-commerce platform when they no longer need the service
  1. The buyer sends the notice through the online termination channel that the Company clearly specifies on the Platform. The notice clearly states the termination request and contains sufficient information for the Company to identify the buyer and the relevant service. The Company has the right to request that the buyer complete a reasonable verification step or provide necessary additional information.

  2. A notice is received by the Company when it enters the system designated by the Company and the Company is able to access it. The fact that the Company has not yet responded or has requested additional information does not change the time of receipt of a notice that already contains all the required content.

  3. The Company acknowledges receipt within 3 working days for consumers, or 5 working days for other buyers, from the date of receiving the notice. An acknowledgment of receipt does not constitute acceptance of the request. The Company handles the request in accordance with the procedure for receiving and handling feedback, requests, and complaints published on the Platform.

Article 6. Refund method upon service termination
  1. The Company issues a refund only when there are grounds under the law, a lawful agreement, or the Company’s approval. The refund amount is determined according to those grounds. The Company has the right to set off mutual obligations that are of the same kind, are both due, are undisputed, and are permitted by law to be set off.

  2. The Company chooses whether to refund through the original payment method or by bank transfer, unless the law or a lawful agreement provides otherwise. The buyer provides any information necessary for the refund that the Company does not yet have. The refund time limit is determined in accordance with the law, a lawful agreement, or a decision of a competent authority.

  3. When a consumer terminates under Point b of Clause 3 of Article 3, the Company refunds the amount paid for the unused part of the service within 30 days from the date the consumer declares the termination. The Company uses the original payment method unless the consumer agrees to another method.
